Behavioral Study on Regional Regulation Violators concerning Urban Street Vendors Arrangement and Parking Management in Philosophical Areas of Yogyakarta

Center for Population and Policy Studies Universitas Gadjah Mada (CPPS UGM) in collaboration with Civil Service Police Unit of Yogyakarta has conducted Behavioral Study on Regional Regulation Violators using qualitative research method. The focus of the study is Regional Regulation Number 26/2002 concerning Urban Street Vendors Arrangement and Regional Regulation Number 2009 concerning Parking Management; and the locus of study in the philosophical areas of Yogyakarta.
Talk Show of Behavioral Study on Regional Regulation Violators held by Civil Service Police Unit of Yogyakarta at Cavinton Hotel Yogyakarta (17/12/2018)Using a sociological approach, the present study reveals four key points. First, economic motivation is the main reason for the non-compliance of urban street vendors and parking officers to the existing regulations. Second, there is no communication, synergy, and coordination among stakeholders who conduct the arrangement and control. Third, violations of the two regulations are always due to “normalization of deviations” committed by policy actors – as the primary stakeholder. Fourth, the normalization of the deviation happens since the law of agency did not work. This is caused by the effects of “invisible secondary stakeholders” on policy actors. Even though these invisible stakeholders are hidden in the back of informality, their power is enormous. They are able to stop the process of regulation enforcement on their own. As a result, some primary stakeholders feel like they have some principals or bosses with conflicting interests, which in the end, these primary stakeholders are not able to perform their duties in accordance with the regulations. Based on these findings, the important recommendation of the present study is to change the relations between policy actors – as primary stakeholders – and invisible secondary stakeholders. The change in relations leads to the certainty and regulation enforcement can be achieved consistently and fairly. The results were presented at Talk Show of Behavioral Study on Regional Regulation Violators held by Civil Service Police Unit of Yogyakarta at Cavinton Hotel Yogyakarta on December 17, 2018. The event presented four speakers; Drs. Ekwanto (Head of Technical Implementation Unit of Malioboro), Dr. Dewi H. Susilastuti, M.Sc (Researcher at CPPS UGM), Triyastuti Setianingrum, S.I.P., M.Sc. (Researcher at CPPS UGM), and Dr. Theresia Anita Christiani, S.H. M.Hum. (Lecturer in Postgraduate Program of Law, Faculty of Law Atmajaya University) with the moderator Yam’ah Tsalatsa Abritaningrum, S.I.P., M.P.A. (Researcher at CPPS UGM).
